Welcome to Wira ("Wira," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website (wirasleep.com) and any purchases made through it. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

SECTION 1 - ELIGIBILITY

To use our Site and place orders, you must be at least 18 years old or have permission from a legal guardian. By placing an order, you confirm that you meet this requirement.

SECTION 2 - ORDERS

All orders are subject to acceptance. We reserve the right to refuse or cancel any order for reasons including but not limited to: product availability, pricing errors, suspected fraud, or violation of these Terms.

SECTION 3 - PRODUCT INFORMATION AND PRICING

Prices are listed in USD. We aim to ensure that all product descriptions and prices are accurate but reserve the right to correct any errors. Color representation may vary based on your device. We reserve the right to update pricing and descriptions without notice.

SECTION 4 - PAYMENT

We accept Visa, MasterCard, American Express, and PayPal. Payments are processed securely through third-party providers. We do not accept cash, checks, or invoicing.

SECTION 5 - SHIPPING AND DELIVERY

Orders are processed within 3 business days. Delivery typically takes 9-12 business days. Delays may occur during holidays, launches, or due to supply chain disruptions. Once a product is handed off to the shipping provider, Wira is not responsible for delays, damages, or losses unless you have purchased Shipping Protection.

SECTION 6 - SHIPPING PROTECTION

Optional shipping protection can be added at checkout. It covers damage, loss, or theft during transit. If the order is canceled before shipment, the protection fee is refunded. Once the order ships, the fee is non-refundable.

SECTION 7 - UNCLAIMED ORDERS AND DELIVERY FAILURES

7.1 Unclaimed Orders: You are responsible for ensuring your shipping address is correct. If your package is returned to us because it was unclaimed, refused, or the address was incorrect, you will be responsible for a handling fee of $15 USD if you request re-shipment. If you choose to cancel the order after return to us, this fee will be deducted from your refund.

7.2 Delivery Timeframe: If your package hasn't arrived within 30 days of shipment, you must contact us within 7 days (37 days from shipment date) to report the issue. Claims made after this period may not be honored.

SECTION 8 - RETURNS AND MONEY-BACK GUARANTEE

We offer a 30-day money-back guarantee on most products, and up to 100 days on selected items as stated on their respective product pages. Products must be returned unused, in original packaging. To request a return, contact support@wirasleep.com with your order number and reason. Return shipping costs are your responsibility unless otherwise specified. Refunds are issued within 14 business days of receiving and inspecting the returned item.

SECTION 9 - POST-PURCHASE UPSELLS

Additional products may be offered after checkout. These are charged separately but linked to the original order. Discounts on upsells are void if the main product is canceled. We reserve the right to adjust pricing or cancel upsells under such circumstances.

SECTION 10 - TESTIMONIALS AND REVIEWS

Customer reviews and testimonials may be edited for clarity and to comply with our content guidelines. We may use fictitious names or stock images to preserve customer privacy. By submitting a review, you grant us permission to use it for promotional purposes.

SECTION 11 - DISCLAIMERS

11.1 Products are sold "as is" without warranties except those expressly stated. To the fullest extent allowed by law, we disclaim implied warranties including merchantability and fitness for a particular purpose.

11.2 Our products are not intended to diagnose, treat, or cure any medical condition. Consult a licensed healthcare professional before use.

11.3 We do not warrant the accuracy of third-party content linked to or from our Site.

(b) We do not guarantee that our products will alleviate or improve any health condition, including but not limited to pain, discomfort, sleep disorders, or allergies;

(c) Our products may cause temporary discomfort during an adjustment period, including but not limited to neck pain, headaches, muscle soreness, or sleep disruption;

(d) You assume all risks associated with the use of our products, including potential allergic reactions, physical discomfort, or worsening of existing conditions;

(e) We strongly recommend consulting with a healthcare professional before using our products if you have any pre-existing medical conditions, injuries, or concerns;

(f) In no event shall Wira be liable for any personal injury, discomfort, allergic reaction, or health-related consequence arising from or related to the use of our products, even if we have been advised of the possibility of such damages.

SECTION 12 - LIMITATION OF LIABILITY

Wira shall not be liable for indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or business, even if advised of the possibility. Our liability is limited to the amount paid for the product giving rise to the claim.

SECTION 13 - FORCE MAJEURE

Wira shall not be liable for any failure to perform due to causes beyond its reasonable control including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, strikes, or shortages of transportation facilities, fuel, energy, labor or materials. In the event of any such delay, Wira may defer the delivery date for a period equal to the time of such delay.

SECTION 14 - INDEMNIFICATION

You agree to indemnify and hold harmless Wira and its affiliates from any claims, damages, or expenses resulting from your breach of these Terms or misuse of the Site or our products.

SECTION 15 - DISPUTE RESOLUTION

15.1 Mandatory Arbitration: You and Wira agree that any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved by binding arbitration on an individual basis in accordance with the American Arbitration Association's rules for arbitration of consumer-related disputes.

15.2 Class Action Waiver: You and Wira agree that any proceedings to resolve disputes will be conducted on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and Wira waive any right to a jury trial.

15.3 Small Claims Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court.

15.4 Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes that are not subject to arbitration shall be resolved in courts located in Delaware.

SECTION 16 - STATE-SPECIFIC CONSUMER RIGHTS

Where required by law, such as in California or New York, consumers may be entitled to additional rights, including extended return periods. We comply with such laws where applicable.

SECTION 17 - INTELLECTUAL PROPERTY

All content on wirasleep.com is owned by Wira or its licensors. You may not use, copy, or distribute any content without written permission.

SECTION 18 - PRIVACY

Your use of our Site is also governed by our Privacy Policy, which details how we collect, use, and protect your information.

SECTION 19 - DATA PROTECTION AND CONSUMER PRIVACY RIGHTS

19.1 California Consumer Privacy Act (CCPA): California residents have specific rights regarding their personal information. 21.2 All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

SECTION 25 - ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other policies or guidelines referenced herein, constitute the entire agreement between you and Wira regarding your use of the Site and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning its subject matter.

SECTION 27 – GOVERNING LAW AND JURISDICTION

These Terms of Service and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Sweden, with the Stockholm District Court (Stockholms tingsrätt) as the first instance.

By using our Site and purchasing our products, you consent to the exclusive jurisdiction and venue of these courts.
